1. Introduction
These Terms & Conditions (“Terms”) govern your use of Homesteading Creative (“Company,” “we,” “us,” or “our”) and the services, products, and offerings provided through our website and business operations.

By booking a service, submitting a project inquiry, signing a proposal, or working with Homesteading Creative in any capacity, you agree to these Terms.
If you do not agree, please do not use our services.


2. Services Offered
Homesteading Creative provides:

• Branding & website design
• AI-generated portraits and product imagery
• AI-generated brand visuals
• AI cinematic advertisements
• Creative consulting
• Strategy sessions and clarity calls
• Digital products (including the Visual Storytelling Audit)

Services may evolve over time. Any updates will be reflected in these Terms.


3. Booking & Payment Policies
Project Acceptance

• A project is confirmed once:
• A proposal or contract is signed
• A deposit or full payment is received (as specified in the agreement)

We reserve the right to decline projects that are not aligned with our creative scope or values.

Payments

• Unless otherwise specified:
• A non-refundable deposit is required to reserve your spot
• Remaining balance is due according to the payment schedule in your proposal
• Work does not begin until payment milestones are met

Late Payments

• In cases of late payment, work may be paused until the account is current.
• Rush Fees
• Rush projects may incur additional fees, which will be communicated before acceptance.

4. Cancellations & Refunds
Due to the time, strategy, and custom creative work involved:
All deposits and payments are non-refundable.

• If you choose to cancel your project:
• You will not receive a refund

You may request a pause or reschedule, subject to availability

If we must cancel a project due to unforeseen circumstances:

• You will receive a refund for the portion of work not completed
• Deliverables already created remain the property of Homesteading Creative unless stated otherwise

5. Client Responsibilities
To ensure a smooth and timely process, clients agree to:

• Provide necessary content, images, inspiration, or direction in a timely manner
• Respond to communications within agreed-upon timelines
• Provide clear feedback during revision rounds
• Deliver accurate and complete information

Delays caused by client inaction may extend project timelines.
Repeated delays may require rescheduling or an additional fee.


6. Creative Direction & Revision Policy
All services include a specified number of revision rounds (outlined in your proposal).

Additional revisions beyond the agreed amount may incur additional fees.

Homesteading Creative maintains final discretion on stylistic decisions to preserve the quality and integrity of the work.

We cannot guarantee specific outcomes (e.g., “exact likeness” in AI portraits) due to the inherent variability of creative and AI-generated processes.


7. AI Image & Film Creation

• You understand and agree that:
• AI images and films are created using third-party AI tools
• Final results may vary based on model behavior, prompts, and creative interpretation
• AI-generated visuals are unique but may contain stylistic similarities to other work
• You grant us permission to use reference images you provide for the sole purpose of creating deliverables for your project
• We do not use your images to train models

You retain rights to your original images.
We retain rights to all AI-generated work unless otherwise stated in your agreement.


8. Intellectual Property + Licensing
Branding & Logos
Final logos and brand elements are licensed to you for business use upon project completion and full payment.
Concept drafts, sketches, unused designs, and creative explorations remain the property of Homesteading Creative.

AI Imagery & Films
Unless otherwise stated:

• You receive a license to use the final images or films for marketing, social media, personal branding, or business use
• You may not resell, redistribute, or use AI visuals for training models or other AI software
• You may not claim authorship of the AI generation process

Portfolio Use
Homesteading Creative retains the right to showcase completed work for portfolio, marketing, and promotional purposes unless a written NDA is signed prior to project start.


9. Project Timelines
Estimated timelines are provided as a courtesy and may shift due to:

• client delays
• revision volume
• unexpected changes
• complexity of creative work

We will communicate any changes promptly.
Expedited timelines may require a rush fee.


10. Communication
All communication will occur via email, HoneyBook/CRM, or scheduled calls.
We respond during business hours, Monday–Thursday.
Messages received outside these hours will be addressed promptly during the next business day.


11. Warranties & Guarantees
We do not guarantee:

• increased sales
• audience growth
• specific performance metrics
• “exact likeness” in AI portraits
• acceptance into specific publications or platforms
• any third-party tool performance

We guarantee professional-quality creative work delivered according to the scope in your proposal.


12. Limitation of Liability
To the fullest extent permitted by law:
Homesteading Creative is not liable for:

• loss of revenue
• business interruption
• indirect or incidental damages
• client misuse of deliverables
• platform outages (Showit, HoneyBook, email providers, etc.)

Your exclusive remedy for dissatisfaction with services is discontinuation of those services.

13. Governing Law
These Terms are governed by the laws of Iowa, without regard to conflict of law principles.

14. Changes to Terms
We may update these Terms from time to time.
Updates will be posted with an updated “Last Revised” date.
Continued use of our services indicates acceptance of revised Terms.
